India wins in Kulbhushan Jadhav's case

On 17 July 2019, relief came to India from the International Court of Justice - The Hague (Netherlands) that Kulbhushan Jadhav, an Indian citizen, has been banned from execution by a Pakistani military court. Apart from this, in the case of Kulbhushan Jadhav, Pakistan was also found guilty of the violation of 'Viena-Agreement'. Pakistan has also been ordered to provide diplomatic assistance to Kulbhushan Jadhav.

 This is a major victory for India at the international level. Senior Advocate Mr Harish Salve had strongly advocated this case in the International Court of Justice. As a result, out of 16 judges, 15 judges gave their decision in favour of India. Only the Pakistani judge opposed it. This victory of India is a legal as well as a diplomatic victory. Kulbhushan Jadhav's safe repatriation is still far away, but it is an important step in that direction.

 On 17 July 2019, Hafiz Saeed, the mastermind of the Mumbai attack, was also arrested in Pakistan. However, Hafiz Saeed has been arrested by Pakistan many times before. But it is released again after a few days. A day before this, on 16 July, Pakistan opened its airspace to Indian aircraft. Which was closed after the airstrike in Balakot. India had earlier requested for this. Because transporting Indian aeroplanes by alternative routes was expensive in terms of cost and time. Pakistan had rejected India's request saying that it would not open its airspace for Indian aeroplanes until India removed its fighter jets from its advance airfield. India did not pay any heed to this illegitimate demand of Pakistan and forced Pakistan to open its airspace to Indian aeroplanes.

 The reason behind all these events is the upcoming visit of Pakistani Prime Minister Imran Khan to America. In which he will meet President Donald Trump and hopes American help to start talks with India. With these steps, Pakistan wants to show that it has made up its mind to deal with terrorism and has also banned many terrorist organizations.

The Government of India is doing a two-sided attack on the Kashmir problem. 'Operation All-Out' is going on in Kashmir Valley. In which most of the hardcore terrorists have been killed. Legal screws are being tightened on separatist leaders. Due to which the voices of his being persuaded for talks are coming. Pakistan is being isolated on international forums and its results have also started coming. On 9 July 2019, the Minister of State for Home Affairs in the Lok Sabha, G Kishan Reddy told that the incidence of infiltration has decreased by 43%. There has been a decrease of 28% in terrorist incidents and a 40% decrease in the incidence of Kashmiri local youth becoming terrorists. It is evident that after the Balakot air strike Pakistan is under pressure at the international level and the separatists at the domestic level have also been battered.

 Pakistan is on the verge of becoming a financial bankrupt as it is named in the 'Gray List' by the Financial ActionTask Force”. In present times Pakistan is under international pressure. Even it may be just for eye washing, but Pakistan is pretending to tighten the terrorist organizations and their masters. If Pakistan could not satisfy the Financial Action Task Force in October 2019, then it can be blacklisted. Due to this Pakistan will not be able to get any financial help at the international level.

 Never before has there been as much pressure on Pakistan as during the tenure of Prime Minister Narendra Modi. Pakistan used to raise the Kashmir issue at every international stage. He tried to internationalize it. But today he is so pressurised on the issue of terrorism that he is now only requesting talks with India. Pakistan's 'ever-green friend' China also sometimes shows its status to Pakistan. Relations between India and China has been generally supportive, except for some issues at the economic and international level. China has voted in favour of India several times against Pakistan. In the case of Kulbhushan Jadhav, the Chinese judge has given a decision in favour of India in the International Court of Justice.

The efforts to return Kulbhushan Jadhav's safely at his home, India should use diplomatic and international forums. Currently, Pakistan is going through its most difficult phase. This is a time in which if the Government of India adopts the right strategy, then there can be a permanent solution to the Kashmir problem and Pakistan can also be made to realize its status.
